Things to Consider When Registering Property Documents in Bangladesh

Purchasing a new property is an exciting time, but it's crucial for buyers to ensure proper documentation to avoid future legal complications. This blog post explores key points for buyers to be aware of when registering property documents in Bangladesh.

Buyer Awareness During Document Registration:

1. Seller's Legal Capacity:

Verify that both the person registering the document (seller) and the owner (also seller) are legally competent adults of sound mind. Confirm that the seller hasn't been declared bankrupt by the court.


2. Document Type:

Ensure the correct document type is used, such as a Sale Deed (Saaf Kabala), Agreement to Sale (Bayana Patra), Gift Deed (Danpatra), or Declaration of Gift (Heba Ghoshonapatra).


3. Land Details and Sale Price:

Double-check the accuracy of the purchased land area and the sale price. In the case of an Agreement to Sale, verify the amount paid as a deposit and the remaining balance.


4. Party Information:

Ensure the full names, addresses, professions, and religions of both the buyer and seller are correctly recorded.
Verify that the buyer's National ID and the seller's latest land record (khatian) match in terms of names and addresses.


5. Property Description:

Confirm the accuracy of the seller's ownership basis, including previous document details (if applicable) like number, date, purchase record/khatian number, etc.


6. Land Inheritance:

If the seller inherited the land, ensure a proper connection exists between the original owner and the seller.


7. Land Schedule:

Verify the accuracy of details like district name, sub-district name, registry office name, mouza name, JL number, plot number, khatian number, and land classification for the proposed land. Confirm the total land area in each plot and the specific area being sold in the sale deed.


8. Land Boundaries:

Ensure an accurate description of the purchased land's boundaries is included, mentioning directions (north, south, east, west) and the names of neighboring property owners.


Additional Tips:

Minimize edits, erasures, and ambiguities in the document. However, if any corrections are necessary, have the document writer clearly note the changes, including the line and word sequence, followed by their signature at the end of the document.


The most crucial aspect for buyers is to ensure accurate recording of various survey plot numbers and khatian numbers through the document writer.  Buyers should visit the Tahsil office beforehand to obtain the correct plot and khatian numbers for the land they intend to purchase.  If necessary, a certified copy of the khatian should be obtained.
